Terms and Conditions of Use

 

  1. The information held in the Digital Asset Management System (the DAMS) is commercial and government information with an intrinsic value and should be treated as OFFICIAL SENSITIVE, in line with HM Government ‘Working with official information’ guidance. Therefore, you must handle the information in confidence and not disclose the information to unauthorised third parties.  
  2. This data is being shared with you as part of a Service Level Agreement (SLA) with the Department for Food and Rural Affairs (Defra) and the Welsh Government, in accordance with The Food Standards Act 1999, Chapter 28, Section 28 – Arrangements for Sharing Information. You agree that all processing, including downloading, exporting, onward use and sharing of the data pursuant to this Agreement must be in compliance with confidentiality requirements and in line with the UK GDPR (as defined in the Data Protection, Privacy and Electronic Communications (Amendments etc) (EU Exit) Regulations 2019), the Data Protection Act 2018 (DPA) and the Human Rights Act 1998 (HRA) In particular (but without limitation), you acknowledge the need to comply with the six key principles set out in Article 5(1) of the UK GDPR; 
  3. You must only use the data from the DAMS for the agreed purpose or purposes; 
  4. You must only access and download data from the DAMS with care to prevent loss or inappropriate access, to deter deliberate or opportunistic theft or misuse and to comply with legal, statutory, security and contractual obligations;   
  5. You must ensure that data from the DAMS is only accessible to those who are authorised to access it and restricted to only those who need to see it; 
  6. Data Breaches - all known or suspected breaches of security in relation to the DAMS data such as: misuse or abuse of the system and the data, loss of data, unauthorised processing of the data, including disclosure, malicious software attack, denial of service attack- must be reported to the FSA’s Information Security Officer, Data Protection Officer, or equivalent  as soon as you become aware of it; 
  7. Complaints/ UK GDPR rights requests/ Freedom of Information requests - if any complaints or UK GDPR rights requests from individuals, or their representatives, are received by a third-party organisation in relation to the data in the DAMS this must be notified as soon as possible to the FSA’s information governance team, Data Protection Officer, or equivalent.
  8. Data exported from the DAMS must be kept securely and managed in line with these terms and conditions, points 1-8; 
  9. The effectiveness of these Terms and Conditions of Use will be reviewed annually by the FSA Animal Welfare Assurance Team, or equivalent; 
  10. Prohibited Uses- You agree and acknowledge that any copyright or database rights subsisting in the DAMS and the data, material and information on it are owned by us or third parties.  You undertake not to: 
  • access, extract, use or copy any data, material or information on the DAMS for any purposes which are unlawful; or
  • use the DAMS in a way that causes or may cause an infringement of the rights of any other party or which breaches any standards, regulations or codes published by any relevant authority; or
  • use the DAMS in any way that interferes with or affects the performance of our systems or which interferes in any way with other users use of the DAMS; or
  • gain, or attempt to gain, any unauthorised access to the DAMS, our other systems and/or to the personal data, information or data of other users; or
  • use the facilities in order to obtain unauthorised access to data or other information belonging to us or any third party. 
  1. You agree to take full and sole responsibility for your use of the DAMS and the data, material and information on it and agree to ensure that data contributed to the Services is accurate, adequate, and kept up to date;
  2. Viruses- You must not introduce or attempt to introduce any virus or other contaminant to the DAMS or any of its software, databases, systems or related networks (including without limitation trojans, worms, logic bombs or other material which is malicious or technologically harmful). You acknowledge, in using the DAMS that you have taken the appropriate security measures in accordance with NCSC guidelines around the processing and downloading of documents, to mitigate risks around viruses and other contaminants; 
  3. Feedback and Complaints - Any queries or feedback you may have in respect of the Service should be submitted by emailing the animal Welfare Assurance Team animalwelfare@food.gov.uk  
  4. General- We may amend the Terms of Use from time to time. If we make any substantial changes, we will notify you by posting a notice on the DAMS landing page. You are bound by any changes we make to these Terms of Use with effect from the date of the change.  You can view the current version of the Terms of Use at any time by clicking on the Terms of Use link on the landing page of the DAMS.
